Terms of Use

These terms govern your use of Trivia Mountain. By using the site you agree to them, so please read them before you play.

1. Acceptance of these terms

By accessing or using Trivia Mountain at https://triviamountain.com (the “Site”) you agree to be bound by these Terms of Use and by our Privacy Policy. If you do not agree with any part of them, please do not use the Site.

2. Who may use the Site

The Site is a general-audience trivia game and is free to use. No account or registration is required. The Site is not directed at children under 13, and we ask that children under 13 do not use it. If you are using the Site somewhere that sets a higher minimum age for online services, that higher age applies to you.

3. Acceptable use

You agree not to:

  • Use automated systems — scrapers, bots, crawlers beyond ordinary search-engine indexing — to access, copy or harvest the Site or its question content.
  • Attempt to gain unauthorised access to the Site, its servers, its database or any associated system, or probe or test their security.
  • Interfere with the Site’s normal operation, including by overloading, flooding or disrupting the service or its infrastructure.
  • Reproduce, redistribute or republish the question sets, in whole or in substantial part, for commercial purposes without written permission.
  • Use the Site for any unlawful purpose or in breach of any applicable law.

4. Intellectual property

The Site’s name, design, layout, source code, text and question sets are owned by the operator of Trivia Mountain or used under licence, and are protected by copyright and other intellectual property laws. You may play the game, and you may quote short extracts with attribution and a link back to the Site. Any other reproduction requires permission.

Individual facts are not owned by anyone. Nothing here is intended to prevent you knowing, repeating or discussing a fact you learned while playing.

5. Accuracy of content

The questions are produced through an automated process and are provided for entertainment purposes only. While considerable effort goes into making them accurate, we do not warrant that every question, answer or piece of content on the Site is correct, complete or current, and no part of the Site should be relied upon as factual authority for any serious purpose — academic, professional, medical, legal, financial or otherwise.

If you spot a mistake, please report it via the contact page. Corrections are made as quickly as we reasonably can.

6. Availability

The Site is provided on an “as available” basis. We do not guarantee uninterrupted access and may suspend, withdraw, modify or discontinue all or any part of the Site — including the daily publication of new questions — at any time and without notice. Scheduled and unscheduled downtime may occur.

7. Third-party advertising and links

The Site is funded by advertising served by third parties, including Google. Adverts and any links they contain are controlled by those third parties, not by us. We do not endorse, and are not responsible for, the content, products, services or privacy practices of any third-party advertiser or linked website. Your dealings with advertisers are solely between you and them.

8. Disclaimer of warranties

To the fullest extent permitted by law, the Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, the operator of Trivia Mountain will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or opportunity, arising out of or in connection with your use of or inability to use the Site — even if advised of the possibility of such damages.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

10. Changes to these terms

These terms may be updated from time to time. The current version always appears on this page, with the date of the most recent revision shown at the top. Continued use of the Site after a change takes effect constitutes acceptance of the revised terms. Material changes will be reflected in that date, so it is worth checking occasionally.

11. Governing law

These terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to any conflict of law provisions. You agree that the courts of the Province of Ontario will have exclusive jurisdiction over any dispute arising out of or relating to these terms or the Site, and you submit to the jurisdiction of those courts.

If you access the Site from outside Canada, you do so on your own initiative and are responsible for compliance with your own local laws. Nothing in this section deprives you of the protection of any mandatory consumer law of the country in which you reside.
